Notes:
- Credit is refundable to residents, but nonrefundable to nonresidents. Phase-out based on greater of earnings or modified FAGI.
- Beginning in tax year 1996, the credit is reduced by the amount of household credit used.
- Beginning in tax year 2002, married taxpayers filing jointly and All other taxpayers have different earnings for the start of the phase-out and income cut-offs.
- Beginning in tax year 2004, New York City full and part-year residents may claim a New York City EITC equal to 5 percent of the Federal credit.
- Beginning in tax year 2009, families with three or more children received an enhanced credit.
- For tax year 2021, the Federal credit was enhanced for taxpayers without qualifying children. However New York State decoupled from this change and based its credit on the existing Federal credit calculation.
- Beginning in tax year 2022, the New York City EITC is increasesd to 10% to 30% of the federal credit. The increase varies based on NY adjusted gross income.
