Rochester Used Car Dealer Jailed For Sales Tax Larceny

The New York State Department of Taxation and Finance announced today the sentencing of a Rochester used car dealer for his October 6, 2011 guilty plea to Grand Larceny in the Fourth Degree.

On December 8, 2011, Zacarr A. Johnson, 34, of 82 Youngs Avenue, Rochester, owner of Zaris Auto, a used car dealership located at 85 Lyell Avenue, Rochester, was sentenced to six months of weekends, half to be served in jail and half to be served in a work program, five years probation, and restitution of $73,754 by Acting Monroe County Court Judge Stephen T. Miller. 

An investigation conducted by the Tax Department found that Johnson had stolen over $73,000 of sales tax by failing to report $919,339.99 of sales between December 1, 2004 and May 31, 2008.  

The Monroe County District Attorney's Office prosecuted the case.  The case originated in the Rochester Criminal Investigations Division. 

The New York State Tax Department offers programs such as the Voluntary Disclosure and Compliance Program to encourage delinquent taxpayers to become compliant without facing criminal prosecution or civil penalties.
